Who runs czartajewnorway.edu.pl portal
The owner of the Portal is Zespół Szkół Technicznych im. W. St. Reymont School in Czartajew (Dluga 130 Street, 17-300 Czartajew; hereinafter referred to as the School Complex).
Who is affected by these Regulations?
Regulations apply to people who use the Portal czartajewnorway.edu.pl, the recipients are both students, entrepreneurs on consumer rights and other entrepreneurs.
Clarification of definitions
Service Provider: The team of technical schools named after him. W. St. Reymonta w Czartajewie (Dluga 130 Street, 17-300 Czartajew; hereinafter referred to as the Zespół Szkół Technicznych).
Portal: Web portal available at: czartajewnorway.edu.pl
Portal User: It is a person who uses or intends to use the Electronic Services provided through the Portal. The user can be a Consumer, Entrepreneur and Entrepreneur on the rights of a consumer.
Entrepreneur: It is a legal entity or a natural person, engaged in business activity, who purchases Content or Digital Service by entering into an Agreement, and from the content of the Agreement it appears that it is directly related to the Entrepreneur’s business activity and has a professional character for the Entrepreneur.
Consumer: This is a natural person making a legal transaction with the Service Provider that is not directly related to his/her economic or professional activity.
Entrepreneur in the rights of a consumer: This is a natural person conducting a business activity, purchasing Content or Digital Service, which is directly related to the business activity of this person, but from the content of the Contract it is clear that the Contract is not of a professional nature for the entrepreneur (e.g., based on the data on the subject of business activity made available in the CEIDG).
Electronic Service: Provision of services by electronic means, within the meaning of the Act of July 18, 2002. on provision of services by electronic means (Journal of Laws of 2020, item 344, as amended), by the Service Provider to the User via the Store’s website.
Technical Requirements
These are the minimum technical requirements, the fulfillment of which is necessary for cooperation with the information and communication system used by the Portal, including the conclusion of a Service Agreement or Contract, i.e.:
- A computer, laptop or other multimedia device with Internet access;
- email access;
- The user must have a valid/active e-mail address, as well as, in certain cases, a keyboard or other pointing device to correctly complete electronic forms;
- access to an up-to-date web browser: Mozilla Firefox, Internet Explorer, Opera, Google Chrome, Safari.
Concluded between the Service Provider and the User of the Portal, the subject of which is the provision of Electronic Services made available through the Portal, under the terms and conditions set forth in these Regulations.

Consumer Rights Act
This document sets out the rules for entering into Agreements and for the provision and use of services, including Electronic Services, made available by the Service Provider through the Portal to Users. The Regulations define the rights and obligations of the User of the Portal who is a User, Entrepreneur or Entrepreneur on the rights of a consumer.
Regulations
General terms and conditions of using the Portal
These Terms and Conditions are made available free of charge to each User in connection with the use of the Portal in a manner that allows its content to be acquired, reproduced and recorded by means of the information and communication system used by the User.
The User is required to read the Terms and Conditions before using the Portal. If the User does not accept its provisions, he/she should not use the Portal. Use of the Portal means that the User has read the Terms and Conditions and is bound by their provisions.
In order to properly use the Portal, it is necessary to meet the Technical Requirements, to have access to a device with the Internet, with an up-to-date operating system and an up-to-date web browser, and to have an e-mail account. The user should also have knowledge of the risks of using the Internet (including online shopping) and secure his device with basic technical security measures (such as antivirus software).
The user is obliged not to provide unlawful content and content prohibited by law (e.g., violating the personal rights of third parties), and to enter data in accordance with the facts.
In particular, the user of the Portal is obliged to:
- use the services and functionalities provided by the Portal in a manner that does not interfere with the functioning of the Portal and in a manner consistent with the provisions of the applicable law, the provisions of the Rules of Procedure, as well as in accordance with customs and rules of social coexistence, also in a manner that does not interfere with the functioning of other Users of the Portal
- not to provide or transmit within the Portal any content prohibited by the provisions of the applicable law, in particular, content that violates the property copyrights of third parties or their personal rights;
- not to post content of an unlawful nature, such as: sending or posting unsolicited commercial information (spam) on the Portal or posting any content that violates the law;
- not to modify in an unauthorized manner the content provided by the Portal;
- Not to take actions aimed at coming into possession of information not intended for the User.
In the event that the User is given the opportunity to review opinions regarding the Service Provider’s cooperation in the scope of the Portal’s activities, the Service Provider shall take reasonable and proportionate steps to verify whether the opinions are reliable and were actually formed on the grounds of cooperation.
The Service Provider takes organizational and technical measures to safeguard the security of the use of the Portal and the functionalities available on the site.
Electronic Services on the Portal
The Service Provider provides the following Electronic Services to the Users through the Portal free of charge:
- Portal access service, where the User can browse the content available on the Portal website.
- Provision of the Portal access service begins from the moment the User successfully calls up the Portal address in his browser window or the User enters the Portal from a redirect from another source. The provision of the Portal access service ends when the User exits the Portal.
Complaints related to the provision of Electronic Services may be submitted in writing to the Service Provider’s registered address or electronically to the address indicated at the beginning of the Regulations.
The Service Provider shall respond to the complaint immediately, but no later than within 14 days of receipt.
In order to speed up the processing of the complaint, it is recommended that the User provide in the description of the complaint information and circumstances relating to the subject of the complaint, in particular the type and date of occurrence of the irregularity and the User’s request, along with the provision of contact information of the complainant.
The requirements given above are in the form of recommendations of the Service Provider only, and do not affect the effectiveness of complaints submitted with the omission of the recommended description of the complaint.
Copyright
The User shall comply with the terms and conditions of this license with respect to the content available on the Portal. The Service Provider may specify the terms of the license separately, placing an appropriate entry in a prominent place in the Portal of the content, the license of which will be regulated differently.
The User has the right to use the Portal exclusively for personal use, unless otherwise indicated in the Portal.
It is forbidden for the User to share content from the Portal without identifying the source, author’s name and address of the Portal.
The content available on the Portal may not be subject to disposition by the User (in particular, resale or distribution and commercial sale).
The license granted to the User does not include the right to:
- Permanently or temporarily reproduce the content available on the Portal, in whole or in part, for any purpose other than to create a copy for personal use, to make any other changes to part or all of the content available on the Portal, to distribute the content available on the Portal for a fee by any means and in any form,
- free distribution of content available on the Portal by any means and in any form.
Unless otherwise specified in the content description, the license is granted for the duration of the use of access to the Portal.
Out-of-court means of dispute resolution, complaint handling and redress for consumers
The Service Provider agrees to submit any disputes arising in connection with the Service Provider’s services to arbitration, mediation. Details will be determined by the parties to the conflict.
Any disputes related to the services provided by the Service Provider will be settled by the common courts, and the applicable law is Polish law.
The user who is a Consumer has the opportunity to use the out-of-court method of handling complaints and claims. The rules of access to these procedures are available at the headquarters and on the websites of district (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, as well as provincial inspectorates of trade inspection, and at the following web addresses of the Office of Competition and Consumer Protection:

It is also possible to use the platform of the online dispute resolution system between consumers and traders at the EU level (ODR platform), which is available at: http://ec.europa.eu/consumers/odr.
The provisions of the Regulations do not thwart the ability of Users to invoke the mandatory provisions of the law governing the protection of consumer rights.
Applicability and amendments to the regulations
The Service Provider may amend these Terms and Conditions for important reasons, in particular: if the terms and conditions for the provision of services on the Portal change, when applicable regulations change, when new Content or Digital Services are introduced, as well as when IT solutions change.
The regulations are governed by Polish law.
Actions related to the Regulations by Users who are not Consumers should be done in documentary form. Any disputes between the Service Provider and non-consumer users will be settled by the court having jurisdiction over the Service Provider’s registered office or place of residence.
The Service Provider may terminate the Agreement for the Provision of Services with the User with 30 days’ notice for important reasons, understood as a change in the laws governing the provision of services by electronic means by the Service Provider affecting the mutual rights and obligations set forth in the Agreement concluded between the User and the Service Provider, or a change in the manner of providing services due solely to technical reasons.
The Service Provider may terminate the User’s Agreement for the Provision of Services upon 14 days’ notice or deny the User’s further right to use the Portal for important reasons, in particular in the case of the User’s flagrant violation of these Regulations, i.e. In situations where the User violates the General Terms of Use of the Portal.
Data protection
The User’s personal data is processed by the Service Provider as a personal data controller.
Provision of personal data by the User is voluntary, but necessary in order to use certain Electronic Services.
Additional information on data processing is available in the Privacy Policy on the Portal’s website.
Final provisions
The Regulations and the appendices to the Regulations constitute a model contract within the meaning of Art. 384 § 1 of the Civil Code Act.
The content of the Regulations is available to Users free of charge on the Portal’s website.
Matters not regulated by these Regulations shall be governed by generally applicable provisions of Polish law, in particular: Civil Code and other relevant provisions of generally applicable law.
Any disputes arising between the Service Provider and the User who is not a Consumer shall be submitted to the court having jurisdiction over the seat of the Service Provider.
The User, by posting any content on the Portal’s website, hereby grants the Service Provider a non-exclusive, royalty-free license to use, fix in computer memory, change, delete, supplement, perform publicly, display publicly, reproduce and distribute, especially on the Internet, such content, without territorial limitation.
The amendment to the Terms and Conditions does not apply to contracts for the provision of Electronic Services concluded before the effective date of the amendment to the Terms and Conditions. In the case of such contracts, the provisions of the Terms and Conditions in effect on the date of the User’s willingness to enter into a contract for the provision of electronic services shall apply.
The Service Provider informs the User by publishing on the Portal about:
- (a) the content of the planned amendment to the Regulations,
- b) the effective date of the amendment to the Regulations,
- (c) the uniform content of the Regulations as amended.
